Oregon Lawmakers Pass Bill Criminalizing Explicit AI-Generated Deepfakes Targeting Women and Children

Criminalizing pornographic, sexually explicit AI-generated images, mostly involving women and children,  has been unanimously approved by the Oregon House in a bipartisan bill that now moves to the Senate for consideration.

 

HB2299 Approved in the Wake of Increased Distribution of  Deepfakes

HB 2299 will criminalize the distribution of artificially generated pornographic material in the wake of a significant increase in the distribution of explicit deepfakes.

The bill updates current legislation to include the distribution of AI-generated and altered images as a crime and amends the definition of an ‘image’ to include reasonably realistic digitally manipulated, altered, or created depictions.

The legislation requires that the defendant acted with intent to harass, humiliate, or injure a victim and as a result that the victim experienced harassment, humiliation, or injury.

HB 2299 classifies the unlawful distribution of an intimate, pornographic image as a Class A misdemeanor which carries a maximum punishment of 364 days in a county jail and/or a fine of $6,250. A judge can also impose probation in addition to and/or instead of jail time.
